Thank you for booking your upcoming PHOTOGRAPHY SESSION through Sarah Kelly. I, (Client) understand that I hold my booking spot for my session with a deposit payable to Sarah Kelly, of which will be determined through my confirmation email with details. Deposits are non refundable. I understand that the balance is payable the day of my photo session and/or within 24-48 hours after the session has been completed. Cancellations: 48 hours notice. If I need to cancel due to unforseen circumstances, Sarah Kelly retains the right to hold my deposit for a reschedule date. Sarah Kelly will take all measures to reschedule for the intended scheduled session. If a date is unavailable, I understand that my deposit will be used for a future booking. In the unlikely event that Sarah Kelly is unable to perform the requirements of this agreement due to an illness, injury, family emergency, act of God, or any other cause beyond her control, Sarah Kelly will make every effort to reschedule the session within a reasonable period of time. If such a situation should occur and it is not possible to reschedule the session, responsibility and liability is limited to the return of all payments received for the session. This limitation of liability also applies to any loss/damage of photographs or failure to deliver photographs for any reason. Liability for a partial loss of photographs shall be pro-rated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund whose total amount cannot exceed the total monies paid by under this Agreement during the time preceding the date on which such liability arises. Sarah Kelly provides a safe environment for photography sessions. Sarah Kelly will take the utmost care to ensure your photography experience is a safe and comfortable environment upon arrival, during, and exiting the location where your session is held. Sarah Kelly and/or the studio property holder hold no responsibility for any damage/loss due to person (Client) or property while on the studio premises and upon entering or leaving the photo studio/location. All images are copyrighted to and remain the property of Sarah Kelly. Clients cannot sell or authorize any reproduction of the images by parties other than the photographer. Clients have unlimited personal rights to photographs purchased and may post to social media with credit to Sarah Kelly. Clients may choose to enhance images taken, edited and/or retouched by Sarah Kelly, and she understands that creativity in sharing your images can sometimes be desired. Credit to the image is requested. Any harassment or abuse (this includes: verbally, sexually, physical, mental or online slander) that commences before, during or after the session/event is not tolerated. I hereby grant Sarah Kelly (photographer) permission to use the images of the individuals listed below for any reasonable purpose, including but not limited to marketing, portfolio display, blog, promos/advertising, galleries, and/or social media purposes. I hereby represent that I have the authority to grant the photographer permission to use the images of my child/children (under the age of 18) for the above listed purposes. I also acknowledge and agree that the images taken are the photographer's exclusive property and that she maintains the full copyright. In the case that I prefer privacy in the presentation of images, Sarah Kelly ensures my privacy by keeping names and personal information confidential.
